Can I evict a tenant without a written lease?

The short answer

The absence of a written lease does not automatically eliminate a resident's rights or permit immediate removal. Determine the legal relationship, applicable tenancy rules and lawful process from the facts.

Reconstruct the arrangement

Collect payment history, messages, move-in dates, prior agreements and ownership records. Distinguish an oral tenancy, holdover occupancy, guest arrangement and other situations with local advice.

Verify the appropriate procedure

Notice, grounds and court requirements depend on the relationship and jurisdiction. Do not substitute a self-written deadline or police request for the civil process that applies.

Example: regular rent payments

A resident has paid monthly rent for a year without a signed document. Treat that history as relevant evidence of an arrangement, not as permission to lock the resident out when a disagreement begins.
