Prepare your Maryland lease

Prepare the agreement for the actual home, parties, occupants, term, rent, payment dates, utilities and charges. Match the completed lease to its attachments and local requirements, and retain a signed packet for both parties.

What to review before signing

Attach the current, unaltered Maryland Tenants' Bill of Rights. Review the condition statement, repair and utility responsibilities, applicable lead materials and registration, mold information and acknowledgement, and any shared-utility billing disclosures. Check whether the current positive-rent-reporting option must be included for this landlord; do not assume an older packet contains every current requirement.

Complete the deposit terms and any limited exception before collecting funds. Give the required receipt and inspection-rights information, and review the holding and interest requirements. Identify a refundable deposit separately from any permitted bond arrangement, and keep its disclosures and payment records together.

Review written entry notices and permitted scheduling separately from rent changes, renewal and ending a tenancy. Landlord and tenant notice obligations differ. Check the actual term, municipality and current protections instead of using a landlord's sixty-day ending summary for routine entry or every tenancy.

Document the starting condition, photographs, promised repairs and maintenance contacts. Keep a forwarding address, inspection records and supporting costs for forty-five-day deposit accounting. Review permitted deductions, interest, estimates and any later final-invoice adjustment, then retain the refund and delivery record. Use the Maryland rental-law guide for the applicable details and protected rights.

Keep monthly dates and ending notices distinct. Record the recurring period, rent due date and terms continuing from an earlier agreement. The ordinary monthly-ending rules call for at least 60 days’ written landlord notice and at least 30 days’ written tenant notice, with a longer tenant period possible under the lease. Review the actual agreement, local requirements and protected circumstances before selecting a final date. Keep the notice and delivery record, and separately arrange keys, condition review and the forwarding address; an ending notice does not replace lawful possession procedures.

Give a rent proposal its own notice and effective date. For an ordinary monthly residential tenancy covered by Maryland’s rent-increase notice rule, plan at least 60 days’ written notice. Identify the proposed amount and first affected payment, and review any longer local notice, local rent limits, agreement terms and housing-program restrictions. Use the required mailing method or the resident’s elected electronic method and retain proof of delivery or transmission. Keep the proposal, resident response and any agreed amendment together. Review coverage and exceptions through the Maryland rent-change guide.

Make the room and shared costs specific. Identify the rented room, included furniture, storage and parking, and list the facilities shared with other residents. Confirm who signs the lease and any permission required for a subletting or roommate arrangement. State each payment and how utilities are divided, including access to supporting bills and the payment schedule. Keep any agreement among roommates consistent with the landlord's lease and its required attachments; changing contributions among residents does not automatically change the landlord's agreement.

Plan household routines and room access. Discuss guests, cleaning, quiet hours, pets and repair reporting before the household begins. Explain how entry to the private room will be requested and scheduled under the applicable state and local requirements, and distinguish that process from access to shared areas or an emergency. Record the room's condition and any promised work. Keep written updates when occupants or responsibilities change, and review the lease's notice and possession procedures if a disagreement cannot be resolved.
