Oklahoma in brief

Oklahoma sets no cap on security deposits, but you must keep the deposit in an escrow account at a federally insured financial institution in Oklahoma and return the balance, with an itemized statement, within 45 days after the tenancy ends, the tenant delivers possession and the tenant makes a written demand. If rent is unpaid, you may end the lease when the tenant does not pay within 5 days after your written demand; for other material breaches the tenant gets 10 days to fix the problem and the termination date must be at least 15 days after the notice is received. Either side ends a month-to-month tenancy with 30 days' written notice counted from service, and you must give at least one day's notice before entering except in an emergency or where notice is impracticable. The Landlord and Tenant Act sets no late fee cap, grace period or rent increase notice, and a lease term making either side pay the other's attorney's fees, or excusing, limiting or indemnifying liability for injury or damage, is unenforceable. State in the lease who accepts service and notices for you, and any flooding of the premises you know of in the past five years.

Application and screening fees

Not set by statute

The Oklahoma Residential Landlord and Tenant Act does not regulate application or screening fees and sets no limit on them.

41 O.S. §§ 101 to 136

More detail (4)
  • The Act governs rental agreements for dwelling units in Oklahoma and says nothing about application or screening fees. 41 O.S. § 103(A)
  • It does bar denying a tenancy because an applicant or household member is a victim of domestic violence, sexual violence or stalking, or because the applicant ended an earlier lease for that reason. 41 O.S. § 113.3
  • It also limits denying a tenancy over a guide, signal or service dog. 41 O.S. § 113.1
  • When reviewing income, Oklahoma bars refusing to count both applicants' income, or verifiable public assistance, alimony or court-awarded child support, because of a listed protected characteristic. This is a qualified nondiscrimination rule; evaluate the income and applicable protections rather than assuming every assistance payment may be disregarded. 25 O.S. 1452(A)(7), (8) See Fair housing

Fair housing

Partly read

Federal law bars refusing to rent to, or setting different terms for, anyone because of race, color, religion, sex, familial status, national origin or disability. Oklahoma also prohibits covered housing discrimination because of race, color, religion, gender, national origin, age, familial status or disability, including in rental terms, services and advertising.

42 U.S.C. § 3604 25 O.S. § 1452(A)

More detail (7)
  • A person with a disability may ask to keep an assistance animal as a reasonable accommodation. Unless the disability or disability-related need is readily apparent, you may ask for reliable documentation of the disability, the accommodation and the link between them, and you may verify it. 41 O.S. § 113.2(B)
  • Documentation bought as a product or service is presumed fraudulent, and you are not liable for injuries caused by an assistance animal allowed as an accommodation. 41 O.S. § 113.2(B) 41 O.S. § 113.2(C)
  • If a tenant gets an accommodation through a knowingly false claim, you may use the lease violation procedure, and a prevailing landlord may be awarded court costs, fees and up to $1,000 in damages. 41 O.S. § 113.2(D)
  • You may not deny or end a tenancy to a blind, deaf or physically handicapped person because of the person's guide, signal or service dog. 41 O.S. § 113.1
  • An occupancy limit of two persons per bedroom is presumed reasonable in Oklahoma, but it does not apply to a child born to the tenants during the lease. 41 O.S. § 117(C)
  • State-law supplement checked October 13, 2026: review the coverage and conditions in 25 O.S. 1453 before claiming an exemption, including its qualified owner-rental, religious/private-club and older-persons housing provisions. An exemption under that section does not remove nondiscrimination duties imposed by other state or federal law. The remaining Title 25 provisions were not reviewed for this supplement. 25 O.S. § 1453
  • State law separately bars an additional nonrefundable fee or an unreasonable rental deposit for a blind, deaf or disabled person's bona fide, properly trained guide, signal or service dog. The resident can remain liable for dog-caused damage. Read this specific dog provision alongside the independent reasonable-accommodation duties that apply to a particular request. 25 O.S. 1452(A)(13), (14), (16)(b)

Required disclosures

Partly read

As part of the lease, state prominently and in writing who at what address accepts service and notices, and disclose in writing the names and addresses of the manager and the owner or the owner's agent at or before the start of the tenancy.

41 O.S. § 116(A)

More detail (4)
  • If you know the premises flooded within the past five years, say so prominently and in writing in the lease. 41 O.S. § 113a(A) See Flood disclosure
  • Before the lease begins, disclose to a prospective tenant that the unit or premises was used to make methamphetamine if you know or have reason to know it, unless an assessment found contamination at or below 0.1 microgram per 100 square centimeters. 41 O.S. § 118(C)
  • For target housing, federal law requires you, before the tenant is bound by the lease, to give the lead hazard information pamphlet, disclose any known lead-based paint or lead-based paint hazards, and provide any lead hazard evaluation report available to you. 42 U.S.C. § 4852d
  • If you sell the property, rent the tenant pays you before getting written notice of the sale counts against the new owner. 41 O.S. § 119(A)
In the Rentari Oklahoma lease

The lease names who accepts service and notices and who manages and owns the property, states known flooding in the past five years when you report it, and Oklahoma flooding and methamphetamine disclosure addenda are available.

Flood disclosure

If you know the premises flooded within the past five years, state that prominently and in writing as part of the written lease. If you do not, a tenant may sue you and recover personal property damage caused by flooding of the premises.

41 O.S. § 113a(A)

More detail (1)
  • Flooding here means general and temporary inundation of normally dry land and structures from the overflow of lakes, ponds, streams, rivers, creeks or other inland waters. 41 O.S. § 113a(B)
In the Rentari Oklahoma lease

When you answer that the premises flooded in the past five years, the lease states it in its text, and an Oklahoma flooding history addendum is available.

Landlord identity disclosure

In the lease, identify prominently and in writing the person and address entitled to accept service and notices, and disclose in writing, at or before the start of the tenancy, the names and addresses of the manager and the owner or an agent authorized to accept service for the owner.

41 O.S. § 116(A)

More detail (3)
  • Keep the information current; the duty also binds any later owner, landlord or manager. 41 O.S. § 116(A)
  • A person who does not comply becomes a landlord under the Act and the owner's agent for receiving service, notices and demands and for performing the landlord's obligations, including spending rents collected for that purpose. 41 O.S. § 116(B) 41 O.S. § 102
  • Termination notices to a landlord who cannot be served personally go by certified mail to the person named under this section. 41 O.S. § 111(E)
In the Rentari Oklahoma lease

The lease names who accepts service and notices and who manages and owns the property, with addresses, and prints that the address was not disclosed if no real address was entered.

Deposits, rent and fees

Security deposit limit

Not set by statute

Oklahoma does not cap the amount of a security deposit. A deposit is any money or property you require as security that is to be returned at the end of the rental agreement, less deductions the Act allows.

41 O.S. § 115 41 O.S. § 102

More detail (2)
In the Rentari Oklahoma lease

The Rentari Oklahoma lease states the deposit amount and says Oklahoma does not cap it.

Deposit return

Return the deposit balance, without interest, within 45 days after the tenancy ends, the tenant delivers possession and the tenant makes a written demand for it. The 45 days do not start until all three have happened.

41 O.S. § 115(B)

More detail (5)
  • You may apply the deposit to accrued rent and to damages caused by the tenant's noncompliance with the Act or the lease, itemized in a written statement. 41 O.S. § 115(B)
  • Deliver the itemized statement by mail, return receipt requested, signed for by a person of statutory service age at the address, or in person to the tenant if the tenant can reasonably be found. 41 O.S. § 115(B)
  • If the tenant makes no written demand within six months after the tenancy ends, the deposit reverts to you and the tenant's interest in it ends. 41 O.S. § 115(B)
  • If you do not comply with the deposit section, the tenant may recover the deposit and any prepaid rent owed. Either side may still recover other damages the Act allows. 41 O.S. § 115(E) 41 O.S. § 115(G)
  • When your interest in the property ends, for example by sale, transfer the deposits to the new owner and tell the tenants in writing the new owner's name and address, or return the deposits to the tenants. 41 O.S. § 115(C)
In the Rentari Oklahoma lease

The lease says the balance, itemized in a written statement delivered in person or by return-receipt mail, comes back without interest within 45 days after termination, delivery of possession and the tenant's written demand, and that it reverts to you if no demand comes within six months.

Deposit account and interest

Keep every damage or security deposit in an escrow account for the tenant at a federally insured financial institution in Oklahoma. The balance is returned without interest.

41 O.S. § 115(A)

More detail (2)
  • Misappropriating a security deposit is a crime punishable by up to six months in county jail and a fine of up to twice the amount taken from the escrow account. 41 O.S. § 115(A)
  • The Act does not require you to pay the tenant interest on the deposit. 41 O.S. § 115(B)
In the Rentari Oklahoma lease

The lease says you keep the deposit in an escrow account for the tenant at a federally insured financial institution in Oklahoma and return the balance without interest.

Move-in condition

Not set by statute

The Act does not require a move-in inspection, checklist or condition report. At the start of the term you must deliver full possession of a unit that meets your repair and habitability duties.

41 O.S. § 117(A)

More detail (2)
In the Rentari Oklahoma lease

The lease has the tenant accept the unit as documented in any move-in condition report and report pre-existing damage in writing within seven days of move-in.

Rent and late fees

Partly read

Rent is due at the time and place you and the tenant agree. The Landlord and Tenant Act sets no late fee amount, no cap and no grace period; Oklahoma's general contract law on penalties was not checked for this page.

41 O.S. § 109(B) 41 O.S. §§ 101 to 136

More detail (3)
  • If the lease is silent, rent is payable at the unit; for a term of one month or less the whole rent is due at the start of the term, and for a longer term one month's rent is due at the start of each month. 41 O.S. § 109(B)
  • If there is no agreement on rent, the occupants owe the fair rental value of the unit. 41 O.S. § 109(A)
  • Rent means every payment due to you under the lease other than deposits and damages. 41 O.S. § 102
In the Rentari Oklahoma lease

The lease states the late charge you set and the day after which it applies, as a term of the lease.

Returned payment fee

Partly read

The Landlord and Tenant Act does not set a returned check or returned payment fee. Oklahoma's separate law on dishonored checks was not read for this page, so no limit is stated here.

41 O.S. §§ 101 to 136

More detail (1)
  • Any payment due to you under the lease, other than deposits and damages, counts as rent under the Act. 41 O.S. § 102
In the Rentari Oklahoma lease

When you set a returned-payment fee, the lease charges that amount for any check or electronic payment returned for insufficient funds.

Rent increase notice

Not set by statute

The Oklahoma Residential Landlord and Tenant Act sets no notice period for a rent increase and no limit on the amount. During a fixed term, the rent is what the lease says.

41 O.S. §§ 101 to 136

More detail (2)

During the tenancy

Landlord entry

Give the tenant at least one day's notice of your intent to enter and enter only at reasonable times, except in an emergency or where notice is impracticable.

41 O.S. § 128(C)

More detail (5)
  • The tenant may not unreasonably withhold consent to entry to inspect, make necessary or agreed repairs, decorations, alterations or improvements, supply services, or show the unit to buyers, lenders, tenants, workers or contractors. 41 O.S. § 128(A)
  • You may enter without the tenant's consent in an emergency. 41 O.S. § 128(B)
  • Do not abuse the right of access or use it to harass the tenant. Apart from the Act or a court order, you have no other right of access during the tenancy unless the tenant has abandoned or surrendered the unit. 41 O.S. § 128(C) 41 O.S. § 128(D)
  • If the tenant refuses lawful access, you may get a court order compelling access or terminate the lease. 41 O.S. § 128(E)
  • If you enter unlawfully, enter in an unreasonable manner or make repeated unreasonable demands for entry, the tenant may get an injunction or, on written notice, end the lease, and in either case recover actual damages. 41 O.S. § 124(A)
In the Rentari Oklahoma lease

The lease requires at least one day's notice (stated in hours, never fewer than 24) except in an emergency or where impracticable, entry only at reasonable times, and no use of entry to harass.

Repairs and habitability

Make all repairs and do whatever is needed to put and keep the unit and premises fit and habitable, and keep the electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances you supply in good and safe working order.

41 O.S. § 118(A)

More detail (7)
  • Except in a single-family residence, keep common areas clean, safe and sanitary. 41 O.S. § 118(A)
  • Except in a one- or two-family residence or where a government provides it, supply trash receptacles and arrange frequent removal. 41 O.S. § 118(A)
  • Except in a single-family residence or where utilities are separately metered to the unit, supply running water, reasonable hot water at all times and reasonable heat. 41 O.S. § 118(A)
  • You and the tenant may agree that the tenant does specified repairs or maintenance only in a conspicuous writing separate from the lease. 41 O.S. § 118(B)
  • The tenant must keep the unit safe, clean and sanitary, use facilities and appliances safely, not damage the premises, and report defects the tenant believes you do not know about as soon as practicable. 41 O.S. § 127 41 O.S. § 125
  • Handing management to someone else does not relieve the beneficial owner of these duties. 41 O.S. § 108
  • If the tenant does not fix a breach that repair, replacement or cleaning can cure, you may have the work done and bill the cost as rent. 41 O.S. § 132(A) See Notice for lease violations
In the Rentari Oklahoma lease

The lease restates your duties to keep common areas clean and safe, keep the unit fit and habitable and maintain the facilities and appliances you supply.

Tenant repair remedies

If you materially fail to comply with the lease, or fail to comply with your repair and habitability duties in a way that materially affects health or safety, the tenant may give written notice that the lease will end on a date at least 30 days after you receive it unless you fix the problem within 14 days.

41 O.S. § 121(A)

More detail (5)
  • Repair and deduct: for a breach materially affecting health that repairs costing no more than one month's rent will cure, the tenant may give written notice and, if you do not act within 14 days (or as fast as an emergency requires), have the work done in a workmanlike manner and deduct the actual and reasonable cost after giving you an itemized statement. 41 O.S. § 121(B)
  • If you willfully or negligently fail to supply heat, running water, hot water, electricity, gas or another essential service, the tenant may give written notice and then end the lease immediately, buy the service and deduct its cost, recover damages for reduced rental value, or get substitute housing and owe no rent while it lasts. 41 O.S. § 121(C)
  • If the unit is uninhabitable or an imminent threat to health and safety and you do not fix it as promptly as conditions require, the tenant may end the lease immediately by written notice describing the problem. 41 O.S. § 121(D)
  • None of these rights arises until the tenant gives you written notice, or if the tenant, the tenant's family, pets or guests caused the condition. 41 O.S. § 121(E)
  • If fire or other casualty substantially impairs the unit and the tenant did not cause it, the tenant may move out and give written notice within one week to end the lease, or stay in the usable part and pay reduced rent. 41 O.S. § 122(A)
In the Rentari Oklahoma lease

The lease describes the 14-day notice remedy, repair and deduct up to one month's rent and the essential-services remedies, and says none of them arises for a condition the tenant's household, animals or guests caused.

Locks and security devices

Not set by statute

The Oklahoma Residential Landlord and Tenant Act sets no lock, rekeying or security device requirement. Local codes were not read.

41 O.S. §§ 101 to 136

More detail (1)
In the Rentari Oklahoma lease

The lease has you provide working exterior locks and bars the tenant from changing or rekeying them without your written permission.

Smoke alarms

Partly read

The Oklahoma Residential Landlord and Tenant Act does not mention smoke alarms. Oklahoma's fire safety laws and local fire codes were not read for this page.

41 O.S. §§ 101 to 136

More detail (1)
In the Rentari Oklahoma lease

The lease has you provide working smoke and carbon monoxide detectors at move-in and bars the tenant from disabling them.

Retaliation

The Oklahoma Residential Landlord and Tenant Act has no general anti-retaliation section. It bars one kind: you may not deny a tenancy to, or retaliate against, an applicant or tenant because they ended an earlier rental agreement as a victim of domestic violence, sexual violence or stalking.

41 O.S. § 113.3 41 O.S. §§ 101 to 136

More detail (1)
In the Rentari Oklahoma lease

The lease adds a contractual promise not to raise rent, reduce services or bring or threaten eviction because the tenant complained in good faith to a government agency or used a legal right, and restates the victim protection.

Lockouts and utility shutoffs

If you wrongfully remove or exclude a tenant from the unit, the tenant may recover possession in court or end the lease, and in either case recover up to twice the average monthly rent or twice actual damages, whichever is greater.

41 O.S. § 123

More detail (3)
  • If the lease ends that way, you must return all recoverable deposits and all prepaid and unearned rent. 41 O.S. § 123
  • If you willfully or negligently fail to supply heat, running water, hot water, electricity, gas or another essential service, the tenant has the essential-services remedies, including ending the lease or getting substitute housing. 41 O.S. § 121(C) See Tenant repair remedies
  • Your lien on a tenant's property is limited and excludes many items, such as clothing, bedding, food, tools of a trade and medical devices. 41 O.S. § 133
In the Rentari Oklahoma lease

The lease says nothing in it lets you change the locks or exclude the tenant except through the court process the law requires.

Ending a tenancy

Ending a month-to-month tenancy

Either you or the tenant may end a month-to-month tenancy by written notice served at least 30 days before the termination date. The 30 days run from the date the notice is served.

41 O.S. § 111(A)

More detail (4)
  • A tenancy shorter than month-to-month, such as week-to-week, ends on 7 days' written notice. 41 O.S. § 111(B)
  • Unless the lease fixes a definite term in writing, the tenancy is month-to-month (week-to-week for a roomer or boarder who pays weekly). 41 O.S. § 110
  • Serve the notice on the tenant personally; if the tenant cannot be located, deliver it to a family member over 12 living with the tenant; if neither can be served, post it in a conspicuous place on the unit and mail a copy by certified mail or through the firm mailing book for accountable mail. Serve a landlord personally or, if that cannot be done, by certified mail. 41 O.S. § 111(E)
  • If you consent to a tenant staying after the term ends, a month-to-month tenancy results unless you agree otherwise. 41 O.S. § 111(D)
In the Rentari Oklahoma lease

The lease says either party ends a month-to-month tenancy by written notice served at least 30 days before the termination date, counted from service.

Ending a fixed-term lease early

A fixed-term lease ends on its end date without notice, unless it is ended earlier under the Act or you and the tenant agreed otherwise (for example, a lease that renews or requires notice to end). If a tenant wrongfully leaves early, you must make reasonable efforts to re-rent the unit.

41 O.S. § 111(C) 41 O.S. § 129(B)

More detail (10)
  • If you re-rent for a term starting before the old lease would have ended, the old lease ends when the new tenancy begins. If you make reasonable efforts but cannot re-rent at a fair rent, the tenant owes the rent or the difference for the rest of the term. 41 O.S. § 129(B)
  • If you do not make reasonable efforts to re-rent, or accept the abandonment as a surrender, the lease is treated as ended by you on the date you learn of the abandonment. 41 O.S. § 129(B)
  • Every party claiming damages under the Act must mitigate them. 41 O.S. § 105(A)
  • A victim of domestic violence, sexual violence or stalking may end the lease without penalty with written notice and a protective order within 30 days of the incident. 41 O.S. § 111(F) See Domestic violence, sexual violence and stalking
  • Under federal law, a servicemember may end a lease signed before entering military service, a lease signed while in service on later permanent change of station or deployment orders for 90 days or more, or a lease signed on such orders that a stop movement order then prevents them from occupying; a spouse or dependent may also end it within one year after the servicemember dies in service, and the servicemember may end it within one year after a catastrophic injury or illness in service. For monthly rent, termination on entry, change of station or deployment takes effect 30 days after the next rent due date following delivery of notice, and termination on a stop movement order takes effect when the notice requirements are met. 50 U.S.C. § 3955
  • If a tenant holds over willfully and not in good faith, you may sue for possession at once and recover up to twice the average monthly rent, prorated daily, for each month or part of a month. 41 O.S. § 111(D)
  • For the federal military termination right, deliver written notice and a copy of the military orders to the lessor or authorized recipient. The statute defines orders to include a commanding officer's notification, certification or verification of current or future duty status, as well as official orders, including separation or retirement. It does not impose a separate military-ID requirement in this notice provision. 50 U.S.C. section 3955(c)(1), (i)
  • Federal notice may be delivered by hand, private carrier, properly addressed U.S. mail with sufficient postage and return receipt requested, or the electronic methods in section 3955(c)(2). These include a designated electronic address, an accessible repository and other means reasonably calculated to ensure actual receipt. Keep evidence of the notice and delivery when applying the effective-date rules. 50 U.S.C. section 3955(c)(2), (d)(1)
  • Under section 3955, rent for the period before termination is prorated and otherwise lawful unpaid obligations, including reasonable excess-wear charges, remain payable, but no early-termination charge may be imposed. Refund prepaid rent for the period after termination within 30 days of the effective date. Knowingly holding covered belongings or a deposit to secure rent accruing after a lawful termination is prohibited. 50 U.S.C. section 3955(e)(1), (f), (h)
  • Sutton v. Jondahl was a 1975 fire-insurer subrogation case. On that record, the court treated the tenant as a co-insured absent an express contrary agreement and rejected the insurer's claimed recovery against the tenant. The opinion does not establish a general lease-termination right or immunity from every damage claim. Its application requires review of the actual lease, coverage and later law. Sutton v. Jondahl, 1975 OK CIV APP2, paragraphs20-26

Notice for unpaid rent

If rent is unpaid when due, you may terminate the lease if the tenant does not pay within 5 days after your written notice demanding payment. That demand is also a demand for possession, so no separate notice to quit is needed.

41 O.S. § 131(B)

More detail (3)
  • You may sue for the unpaid rent at any time after it is due, or wait until the 5 days have run. 41 O.S. § 131(A)
  • The demand may be given before or after you file a suit for the rent. 41 O.S. § 131(B)
  • Serve written termination notices on the tenant personally; if the tenant cannot be found, deliver to a family member over 12 who lives there; otherwise post the notice in a conspicuous place on the unit and mail a copy by certified mail or through the Postal Service's firm mailing book for accountable mail. 41 O.S. § 111(E)
In the Rentari Oklahoma lease

The lease says you may terminate if the tenant does not pay within five days after written notice of your demand, and that the demand is also a demand for possession.

Notice for lease violations

For a material breach of the lease or the tenant's duties, give written notice describing it and stating that the lease will end on a date at least 15 days after the tenant receives the notice unless the breach is fixed within 10 days.

41 O.S. § 132(B)

More detail (5)
  • If the tenant fixes the breach within the 10 days, the lease does not end for that breach. A later breach allows immediate termination on written notice. 41 O.S. § 132(B)
  • For a breach that repair, replacement or cleaning can fix, if the tenant does not act within 10 days after written notice (or as fast as an emergency requires), you may do the work and bill the reasonable cost as rent due on the next rent date; you then cannot terminate for that breach. 41 O.S. § 132(A)
  • If the breach causes or threatens imminent and irremediable harm to the premises or any person and is not fixed as promptly as conditions require, you may terminate by filing a forcible entry and detainer action right away. 41 O.S. § 132(C)
  • Criminal activity that threatens other tenants' health, safety or peaceful enjoyment or endangers the premises, and drug-related criminal activity on or near the premises, by the tenant, a household member or a guest, are grounds for immediate termination. 41 O.S. § 132(D) 41 O.S. § 127
  • Serve these notices the way termination notices must be served: on the tenant personally; if the tenant cannot be located, on a family member over 12 living with the tenant; and only if neither can be served, by posting in a conspicuous place on the unit and mailing a copy by certified mail or through the firm mailing book for accountable mail. 41 O.S. § 132(B) 41 O.S. § 111(E)
In the Rentari Oklahoma lease

The lease restates the 10-day chance to fix with a termination date at least 15 days after receipt, immediate termination for a later breach, and immediate termination for criminal activity, drug activity or imminent harm.

Eviction process

Partly read

Oklahoma evictions are forcible entry and detainer actions in court. The Act sets the notices that come first; the court procedure itself is in Title 12, which was not read for this page.

41 O.S. § 105(B) 41 O.S. § 131(B)

More detail (7)
  • For unpaid rent, the 5-day written demand is also the demand for possession. 41 O.S. § 131(B) See Notice for unpaid rent
  • Rights under the Act may be enforced in any court with jurisdiction, including small claims, and may be pursued as part of a forcible entry and detainer action. The prevailing party in an action on the lease or the Act is entitled to reasonable attorney's fees. 41 O.S. § 105(B)
  • For imminent and irremediable harm, you may end the lease by filing a forcible entry and detainer action right away. 41 O.S. § 132(C)

Abandoned property

If a tenant abandons, surrenders or is evicted and leaves property of apparent value, store it with reasonable care and send written notice by certified mail to the last known address that it will be deemed abandoned if not removed by the time stated. Property left with you for 30 days or longer is conclusively abandoned and may be disposed of in any reasonable way.

41 O.S. § 130(B)

More detail (4)
  • Property that in your judgment has no ascertainable or apparent value, and perishable property, may be disposed of without accounting to anyone. 41 O.S. § 130(A)
  • You may store the property in the unit, at a cost not above its fair rental value, or at a commercial storage company at its actual charge plus removal; if the tenant reclaims it in time, you may collect storage costs and other amounts due under the lease. 41 O.S. § 130(C) 41 O.S. § 130(D)
  • If you follow the section you are not liable for disposing of the property; if you deliberately or negligently violate it, you are liable for actual damages. 41 O.S. § 130(E)
  • When a sole occupant dies, you may remove and store the property, release it, and the deposit less lawful deductions, to the person the tenant designated or another person lawfully entitled, and discard it only if you sent that person a certified-mail request, return receipt requested, the property was not removed by the 30th day after the postmark, and no one has claimed it before you discard it. You may ask tenants in writing to name that person. 41 O.S. § 130.1
In the Rentari Oklahoma lease

The lease restates that property of no apparent value may be disposed of, that other property is stored with reasonable care after a certified-mail notice, and that property left 30 days or longer is conclusively abandoned.

Lease terms Oklahoma does not enforce

A lease may not make either party waive rights under the Act, confess judgment, pay the other party's attorney's fees, excuse, limit or indemnify liability for injury or damage caused in operating or maintaining the premises, create a lien the Act does not allow, or limit the right to call police or emergency help. Any such term is unenforceable.

41 O.S. § 113

More detail (3)
  • Any part of a written or oral agreement that conflicts with the Act is unenforceable. 41 O.S. § 103(B)
  • Although the lease cannot shift attorney's fees, the Act itself entitles the prevailing party in an action on the lease or the Act to reasonable attorney's fees. 41 O.S. § 105(B)
  • House rules bind the tenant only if they serve a proper purpose, are reasonable, apply fairly to all tenants, are clear, do not evade your duties and the tenant had notice of them at signing or when adopted. 41 O.S. § 126(A)
In the Rentari Oklahoma lease

The lease leaves out attorney's fee and indemnity terms, says why, and says it does not limit anyone's right to call police or emergency help.

Domestic violence, sexual violence and stalking

You may not deny, refuse to renew or end a tenancy because an applicant, tenant or household member is a victim or alleged victim of domestic violence, sexual violence or stalking, whether or not there is a protective order. A victim may end a lease without penalty by giving written notice and a protective order within 30 days of the incident, unless you waive that time limit.

41 O.S. § 113.3 41 O.S. § 111(F)

More detail (2)
  • You also may not deny a tenancy to, or retaliate against, someone because they ended an earlier lease as a victim. 41 O.S. § 113.3
  • A lease may not limit a tenant's right to summon police or other emergency help. 41 O.S. § 113(A)(6)

Local rules

Rent control and local rules

Partly read

State law bars municipal governing bodies from controlling rent charged for privately owned single-family and multiunit residential rentals. The statute preserves specific municipal-property and subsidized-housing arrangements, summarized below. Local building and housing codes can still add duties; this summary does not review each city's ordinances.

11 O.S. § 14-101.1: municipal rent-control prohibition

More detail (2)
  • Building and housing codes, which include local ordinances on fitness for habitation, can add duties for rental property. 41 O.S. § 102
  • The statute preserves regulation of property owned by the municipality or its authority, agreements with private owners for subsidized rentals, and rent restrictions for property assisted with federal Community Development Block Grant funds. Check the property's actual funding and agreements rather than assuming every rental is outside a regulated program. These exceptions do not establish a general rent cap for private rentals. Oklahoma cities and counties

Cities and counties have their own housing, building, fire and other codes that can add duties for rental property. None was read for this page, so no local rule is listed here; check the codes of the city and county where the property is located.

Oklahoma landlord questions

Is there a limit on security deposits in Oklahoma?

No. The Act sets no maximum. It does require you to keep the deposit in an escrow account at a federally insured financial institution in Oklahoma.

41 O.S. § 115(A)

When do I have to return the deposit?

Within 45 days after the tenancy ends, the tenant delivers possession and the tenant makes a written demand. Return the balance without interest, with a written itemized statement of any rent or damages you kept. If no written demand comes within six months after the tenancy ends, the deposit reverts to you.

41 O.S. § 115(B)

What happens if I do not follow the deposit rules?

The tenant may recover the deposit and any prepaid rent owed. Misappropriating a deposit is also a crime punishable by up to six months in jail and a fine of up to twice the amount taken.

41 O.S. § 115(E) 41 O.S. § 115(A)

How much notice do I need to give before entering?

At least one day's notice, and entry only at reasonable times, except in an emergency or where notice is impracticable. You may enter without consent in an emergency.

41 O.S. § 128(B) 41 O.S. § 128(C)

How much notice is required for unpaid rent?

You may terminate the lease if the tenant does not pay within 5 days after your written demand for payment. The demand also counts as a demand for possession, so no separate notice to quit is needed.

41 O.S. § 131(B)

How do I end a month-to-month tenancy?

Serve written notice at least 30 days before the termination date. The 30 days run from service: serve the tenant personally; if the tenant cannot be located, deliver it to a family member over 12 who lives with the tenant; only if neither can be served, post it in a conspicuous place on the unit and mail a copy by certified mail or through the Postal Service's firm mailing book for accountable mail.

41 O.S. § 111(A) 41 O.S. § 111(E)

Can I charge a late fee in Oklahoma?

The Landlord and Tenant Act sets no late fee amount, cap or grace period, so the fee comes from your lease. Oklahoma's general contract law on penalties was not checked for this page.

41 O.S. § 109(B) 41 O.S. §§ 101 to 136

How much notice do I need to raise the rent?

The Act sets no notice period and no limit on the amount. During a fixed term the lease controls the rent; a month-to-month tenancy can be ended on 30 days' written notice.

41 O.S. §§ 101 to 136 41 O.S. § 111(A)

Can my lease make the tenant pay my attorney's fees?

No. A lease term making either party pay the other's attorney's fees is unenforceable. The Act itself lets the prevailing party in an action on the lease or the Act recover reasonable attorney's fees.

41 O.S. § 113(A)(3) 41 O.S. § 105(B)

What can a tenant do if I do not make repairs?

For a material breach of the lease, or a failure in your repair duties that materially affects health or safety, the tenant may give written notice ending the lease at least 30 days after you receive it unless you fix it within 14 days. If the problem materially affects health and repairs costing no more than one month's rent will fix it, the tenant may give 14 days' written notice and then repair and deduct.

41 O.S. § 121(A) 41 O.S. § 121(B)

Can I change the locks on a tenant who stopped paying?

No. If you wrongfully remove or exclude a tenant, the tenant may recover possession or end the lease and recover up to twice the average monthly rent or twice actual damages, whichever is greater.

41 O.S. § 123

What do I do with property a tenant leaves behind?

Property of no apparent value may be disposed of. For property of apparent value, store it with reasonable care and send certified-mail notice to the last known address; property left 30 days or longer is conclusively abandoned.

41 O.S. § 130(A) 41 O.S. § 130(B)

Does Oklahoma protect tenants from retaliation?

The Act has no general anti-retaliation section. It does bar denying, refusing to renew or ending a tenancy because someone is a victim of domestic violence, sexual violence or stalking, and retaliating because a victim ended an earlier lease.

41 O.S. § 113.3

What disclosures does an Oklahoma lease need?

State who at what address accepts service and notices and the names and addresses of the manager and owner, and any flooding you know of in the past five years. Before the lease begins, disclose methamphetamine manufacture in the unit or premises that you know or have reason to know of, unless an assessment found contamination at or below 0.1 microgram per 100 square centimeters. Federal lead paint rules apply to target housing.
