Colorado room rental agreement

Written for Colorado law, checked September 24, 2026 General information, not legal advice

Rentari offers a general room-rental agreement form, but it is not tailored to Colorado or every local rule. Review the room, shared spaces, occupancy requirements, and applicable Colorado and city rules before using a form. The state table below covers selected deposit and entry rules, not every room-rental requirement.

Colorado rules that apply

2 months' rent
two monthly rent payments
C.R.S. § 38-12-102.5(1)

and it must be refundable
C.R.S. § 38-12-106(1)

Security deposit limit

A landlord may not require a security deposit larger than two monthly rent payments under the rental agreement. A security deposit is any advance or deposit of money, whatever it is called, whose main purpose is to secure the tenant's performance of the rental agreement.

C.R.S. § 38-12-102.5(1) C.R.S. § 38-12-102(6)

More detail (3)
  • From January 1, 2027, the two-month cap does not apply to a post-closing occupancy agreement under a purchase contract in which the landlord bought the home from the tenant. C.R.S. § 38-12-102.5(2)
  • A separate security deposit for a pet may not be more than $300, and it must be refundable. C.R.S. § 38-12-106(1)
  • A lease term that waives or changes any part of the deposit law that protects the tenant is void. C.R.S. § 38-12-103(7)(a)
In the Rentari Colorado lease

The Rentari Colorado lease states the two-month cap, and the lease builder will not accept a security deposit above two months' rent or a pet deposit above $300.

Landlord entry

Not set by statute

No section of Colorado's landlord and tenant article sets a general notice period for entering an occupied home, so put entry terms in the lease. Two situations have their own rules: entry for habitability repairs and entry for bed bugs.

C.R.S. § 38-12-101 to 38-12-1502

More detail (2)
  • To enter for repairs of a habitability condition, give at least 24 hours' written notice with the date, time and estimated length of the visit, unless the condition imminently threatens life, health or safety or is causing ongoing substantial damage. The tenant may reasonably decline the time, and you then propose another. C.R.S. § 38-12-503(6)
  • To inspect for or treat bed bugs, give reasonable written or electronic notice at least 48 hours before entry, unless the lease sets a different minimum or the tenant waives it. The tenant may not unreasonably deny access. C.R.S. § 38-12-1004(1)
In the Rentari Colorado lease

The Colorado lease says Colorado sets no general entry notice period, requires written notice for non-emergency entry as a lease term (24 hours unless you set more), and gives 48 hours' notice before a bed bug inspection or treatment.
