New Jersey room rental agreement
Written for New Jersey law, checked October 1, 2026 General information, not legal advice
Rentari offers a general room-rental agreement form, but it is not tailored to New Jersey or every local rule. Review the room, shared spaces, occupancy requirements, and applicable New Jersey and city rules before using a form. The state table below covers selected deposit and entry rules, not every room-rental requirement.
New Jersey rules that apply
- Security deposit limit
- 1.5 months' rent
- yearly increases capped at 10 percent of the deposit
- N.J.S.A. 46:8-21.2
- Entry notice
- Not verified
- no statute read sets one; state housing regulations not read
- N.J.S.A. 55:13A-7
Security deposit limit
You may not require more than one and one-half times one month's rent as security for a home used as a dwelling. If you later collect additional security, the yearly increase may not be more than 10 percent of the current deposit.
More detail (3)
- Money held as security stays the tenant's property: you hold it in trust, and it may not be mixed with your own money. N.J.S.A. 46:8-19
- The Security Deposit Act covers every rental used as a dwelling except an owner-occupied building with no more than two rental units, and even there the tenant can bring it into play by giving you 30 days' written notice. N.J.S.A. 46:8-26
- A lease term in which the tenant waives any part of the Act is void. N.J.S.A. 46:8-24
The Rentari New Jersey lease states the deposit and says all security, including any pet deposit and rent paid in advance as security, may not exceed one and one-half months' rent.
Landlord entry
Partly readNo New Jersey statute read for this page sets a notice period before you enter a tenant's home. The state's housing maintenance regulations for multiple dwellings were not read and may address entry, so check them before relying on a lease term.
The Rentari New Jersey lease says New Jersey has no statutory notice period and promises written notice at least the number of hours you set, 24 by default, for non-emergency entry at reasonable times.
