South Dakota room rental agreement
Written for South Dakota law, checked September 24, 2026 General information, not legal advice
Rentari offers a general room-rental agreement form, but it is not tailored to South Dakota or every local rule. Review the room, shared spaces, occupancy requirements, and applicable South Dakota and city rules before using a form. The state table below covers selected deposit and entry rules, not every room-rental requirement.
South Dakota rules that apply
- Security deposit limit
- 1 month's rent
- more only by agreement where special conditions endanger the premises
- SDCL § 43-32-6.1
Security deposit limit
A residential security deposit may not be more than one month's rent. Any money whose purpose is to secure the tenant's performance under the rental agreement counts as a security deposit, whatever it is called.
More detail (1)
- A larger deposit is allowed only if landlord and tenant agree to it where special conditions pose a danger to maintenance of the premises. SDCL § 43-32-6.1
The Rentari South Dakota lease states the deposit amount and says it may not exceed one month's rent unless landlord and tenant agree on more where special conditions pose a danger to maintenance of the home.
Landlord entry
Except in an emergency or where it is impracticable, give the tenant reasonable notice of your intent to enter and enter only at reasonable times. Twenty-four hours' written notice is presumed reasonable unless the lease sets other methods or times the two of you agreed on.
More detail (1)
- The notice must give the date or dates of entry, a period during normal business hours, the purpose of the entry and a way for the tenant to ask to reschedule. SDCL § 43-32-32
The lease states the statutory notice rule and, as a term of the lease, promises at least the landlord's chosen number of hours of written notice (24 by default) with the required contents.
