Can a tenant withhold rent for repairs?

The short answer

Rent-withholding rights and procedures vary by jurisdiction and circumstances. Neither party should assume that every repair complaint permits withholding or that every withheld payment can be treated as ordinary nonpayment.

Document both issues

Record the condition, reports, access arrangements and repair response alongside the payment record. Continue addressing the property condition while obtaining qualified advice on the disputed rent.

Check the local remedy

Review required notice, seriousness of the condition, timing, escrow or court requirements and available defenses with official local resources. A general online example is not a substitute for the applicable procedure.

Example: payment is disputed

A resident withholds part of rent over a recurring defect. Investigate the defect and review the legal position before sending a notice that assumes the entire dispute is only a ledger problem.

Identify the remedy being claimed

Ask which remedy the resident is claiming and under which current local rule. These are different issues to review:

  • Withholding: some or all rent remains unpaid while the condition and right to withhold are disputed.
  • Repair and deduct: the resident claims a deduction for actual repair spending. Preserve the report, work description, invoice and proof of payment; spending money alone does not establish a valid deduction.
  • Rent adjustment: an agreed or legally determined reduction for affected use is different from an unexplained unpaid balance. Record the period, amount and basis.
  • Court deposit or escrow: check whether a specific court or local procedure applies, who receives the money and what orders govern it. A private account is not automatically the required court process.

For a bounded example, the California Department of Real Estate's 2026 guide discusses repair-and-deduct and withholding separately, with different conditions and risks. Its withholding discussion recommends saving the disputed money and distinguishes suggested escrow from a legal requirement. Verify current local rules before applying any example elsewhere; setting funds aside does not guarantee protection or erase a balance.

Prepare a repair and rent review without delaying the work

Bring the actual address and applicable housing program, lease and repair terms, first report and delivery evidence, observed condition, inspection or vendor findings, access communications, work and follow-up dates, claimed remedy, disputed rent period and amount, and any existing notice or court papers to a qualified local reviewer. Separate what each person reported from verified findings and identify what remains unknown.

Continue the repair response while reviewing the rent question. A scheduled visit does not prove completion, and an overdue software balance does not decide whether withholding is lawful. Review any proposed charge or payment-enforcement notice against the actual dispute before acting. A repair complaint followed by a landlord action requires a review of applicable anti-retaliation protections and the facts; the timing alone is not a finding on this page.

Use the lawful access process, retain original records and record any agreed adjustment separately. Rentari can help organize maintenance and payment records; it does not decide habitability, approve a deduction, hold court escrow or determine a legal outcome.

Common questions

Is repair-and-deduct the same as withholding rent?

No. A repair deduction concerns claimed repair spending; withholding concerns rent left unpaid. Their availability, notice, limits and other requirements depend on the applicable local rule and facts. Keep the spending and payment records separate and obtain qualified review before using either remedy.

Does keeping rent in a separate account make withholding lawful?

No. Saving the money is different from satisfying the local remedy or a required court-deposit process. Check the correct procedure and any existing order. A private account or software record does not guarantee a lawful deduction, protection from a notice or a particular court result.
