Answer · Tenant screening

What questions can't I ask a rental applicant?

The short answer

Keep application questions relevant to the tenancy and permitted in the property jurisdiction. Avoid questions about protected characteristics, and check local rules governing criminal history, income and other screening information.

Focus on the rental process

Ask for relevant contact details, intended lease timing and information needed for the lawful application process. Explain why a document is requested. Do not collect sensitive personal details simply because a form has room for them.

Avoid protected-characteristic questions

Questions about religion, family planning or disability diagnoses can create serious fair-housing concerns. Handle accommodation requests through an appropriate separate process. Federal protections and additional state or local protections must be considered together.

Review the complete workflow

Check inquiry forms, showing conversations, online applications and reference scripts, not just the final form. A third-party template may contain questions that are unsuitable for your location. Have uncertain questions reviewed before using them with applicants.

Your next-step checklist

  • State why each field is needed
  • Remove irrelevant sensitive questions
  • Check local restrictions
  • Review informal screening conversations too
