What if tenant damage exceeds the security deposit?

The short answer

A deposit balance does not cap or prove a tenant's legal liability. Document the loss, complete the required deposit process and obtain advice on insurance or lawful recovery of any remaining amount.

On this page

Establish the actual loss

Separate ordinary wear, pre-existing defects, owner improvements and supported damage. Retain condition evidence, invoices and any applicable depreciation or useful-life analysis required by local rules.

Coordinate recoveries

Review insurance reporting obligations and avoid collecting the same loss twice through a deposit, insurer or resident payment. Keep the accounting and any later corrections traceable.

Example: an insurer pays part

After a lawful deposit deduction, insurance pays part of the same covered loss. Reconcile the recoveries and obtain advice on deductibles, subrogation and remaining claims instead of demanding the original total again.
