The short answer
Apparent vacancy is not conclusive legal abandonment. Review the jurisdiction's criteria, agreement and evidence before retaking possession, changing locks or handling remaining belongings.

Verify the facts lawfully
Document communications, payments, returned keys and observations obtained through permitted access. An unanswered message, travel or reduced belongings alone may not resolve the resident's right to possession.
Follow the required process
Obtain local advice on notices, re-entry, property storage, mitigation and final accounting. Keep deposit handling and recovery of any unpaid obligations traceable and separate.
Example: rent stops and lights are off
Those facts may justify investigation but do not automatically establish abandonment. Confirm the lawful next step before reletting a unit whose possession status remains uncertain.
Build a dated record without treating silence as surrender
Record rent due and paid, messages and responses, keys actually returned and observations obtained through lawful access. Keep verified facts separate from assumptions. A hospital stay, travel or interrupted service can explain absence without surrendering possession.
Use the established private contact route and limit information shared with others. An emergency contact does not automatically have authority to end a tenancy or take belongings. If death is reported, verify the appropriate estate or surviving-occupant process. Continue applicable maintenance, essential services and lawful entry duties. Do not change locks, interrupt utilities or remove property to force an outcome.
Before reletting, identify the lawful possession decision, required notice and delivery record, responsible reviewer and unresolved issues. Keep that decision separate from the belongings process and deposit closeout.
Check the actual notice and belongings procedure
Washington RCW 59.18.310 combines rent default with words or actions reasonably indicating an intent not to resume the tenancy and requires reasonable mitigation efforts. Its belongings rules include notice and a general 45-day disposition period, with a conditional low-value exception and special treatment of personal papers and keepsakes. Deceased-tenant property is directed to another section. Do not use one deadline for every item or situation.
Florida's 2026 section 715.104 concerns belongings after tenancy has ended and the premises are vacated. It requires notice to the former tenant and other reasonably believed owners. The claim date must allow at least 10 days after personal delivery or 15 after mailing, and the section specifies content and address rules. This is not permission to presume the tenancy ended.
Check the entire applicable local procedure before storage, retrieval, sale or disposal. Document authorized access, inventory, notice, permitted costs and release; do not apply these examples outside their jurisdiction.
Clarify future lease communication without overriding rights
Have future lease terms explain permitted absence notices, private contact information, lawful access and the location's possession and belongings process. A lease cannot create unrestricted self-help authority. Keep any unpaid balance, mitigation record, deposit accounting and actual storage charges distinguishable; a clause does not guarantee collection or prevent abandonment.

Common questions
How many days away establish tenant abandonment?
There is no universal absence period. Review local criteria, payment and communication facts, the tenancy and required procedure. Travel or silence alone does not establish surrender.
Is a dark, unpaid apartment automatically abandoned?
No. Those observations may justify lawful investigation, but do not establish intent or returned possession by themselves. Keep essential duties and the actual review process active.
What should an owner do before renting the unit again?
Confirm lawful possession through the applicable procedure, document required notices and decisions, and handle belongings separately. Do not use a lock change or property removal to decide the issue.
What if the resident asks to retrieve belongings?
Confirm identity or lawful representative authority, the applicable retrieval rights, notice dates and any permitted costs. Do not assume unpaid rent or every claimed storage charge may block release. Record the authorized handoff.
