Answer · Leases & renewals

What makes a lease clause unenforceable?

The short answer

A lease clause may be unenforceable when it conflicts with mandatory law or fails other applicable legal requirements. A signature or an AI-generated approval does not make every clause valid.

Look for the actual conflict

Review waivers of protected rights, entry permissions, fees, deposits and termination terms against official requirements for the property. Check local and program rules as well as state law. Avoid deciding from a clause title alone.

Review the consequence carefully

An invalid clause does not automatically tell you what happens to the rest of the agreement. Have the specific text and facts reviewed before enforcing it, demanding money or presenting a revised form as an existing obligation.

Example: unrestricted entry

A template permits entry at any time for any reason. Compare that language with the actual entry rules and tenancy. Correct the future template through review, but separately determine how any current agreement must be handled.
