Rental arbitrage: permission, obligations, and a realistic budget

The short answer

Leasing a home and renting it onward requires permission and a workable legal and operating plan. A potential spread between two prices is not the same as profit.

Confirm every relevant permission

Read the lease's subletting and use terms, local rental and short-stay rules, association restrictions, licensing, taxes, and insurance. Obtain the owner's informed written approval for the specific arrangement. An online platform accepting a listing does not establish that the use is permitted.

Identify whether the operator is offering an ordinary sublease, furnished housing, or short stays. Define permitted occupants, stay lengths, advertising, access, and any services. Review the arrangement with qualified local advisers before signing or accepting bookings.

Assign responsibilities clearly

Specify who screens occupants, collects payments, handles deposits, responds to emergencies, maintains equipment, and pays for damage. Check the contractual and legal relationship between owner, operator, and occupant. The operator's agreement with a guest does not automatically change the owner's duties.

Agree on records, complaint handling, insurance evidence, and a lawful exit process. Avoid an arrangement in which each party assumes someone else is available for urgent repairs.

Check readiness and plan for permission changes

Before committing to guest dates, keep a readiness record for this exact unit and proposed use: the owner's executed approval, lease limits, applicable association and financing restrictions, required government approvals, insurer's response and platform requirements. Record the responsible person, allowed stays or occupancy, evidence, expiration and next review date. An application for approval or an insurance certificate alone does not establish every required permission or coverage term.

Test the practical handoff: keys and access, cleaning between stays, required safety checks, guest instructions, repair contact and after-hours backup. Airbnb's U.S. hosting guidance treats permissions, local requirements, emergency arrangements and insurance as separate checks. Confirm the actual paid-guest use with the insurer and review exclusions and limits; the platform's protection description does not replace that review. Assign who documents the checks and follows up on unresolved items.

Agree what happens if an approval expires, coverage changes, a rule changes or the unit is not ready. Identify who reviews new booking availability, communicates with affected guests and owner, handles permitted refunds or relocation, and checks continuing obligations under the actual contracts and local rules. Avoid accepting new stays beyond an unresolved permission or readiness limit. A booking pause, a platform cancellation and ending the master lease are different actions; no automatic termination right follows from this checklist. Include the remaining base rent and wind-down costs in the downside budget.

Budget for vacancy and failure

Include base rent, utilities, furniture, platform charges, permits, insurance, cleaning, replacements, refunds, taxes, and administration. Model vacancies and seasonal changes. Keep a reserve for obligations due even when no guest or subtenant pays.

For illustration, $3,000 of revenue less $2,000 of base rent and $700 of other costs leaves $300 before omitted costs and tax. One unplanned $600 repair changes that month's result to a loss. Do not treat peak occupancy or an advertised nightly price as guaranteed income.

Common questions

Does a permit lapse automatically end the operator's lease?

No automatic right is established here. Check the actual lease, permit conditions and local rules with qualified advice. Plan separately for booking availability, current guests, refunds and continuing lease obligations.

Must an arbitrage lease run for twelve months?

There is no universal optimum. Compare the proposed term with permission validity, startup costs, seasonal downside, remaining rent and lawful exit obligations. A full seasonal period can inform planning but does not guarantee enough bookings to recover costs.
