From the Kansas lease

KANSAS RESIDENTIAL LEASE AGREEMENT

If rent is unpaid when due, Landlord may give written notice of the nonpayment and of Landlord's intention to terminate this Lease if the rent is not paid within three (3) days, counted as three consecutive 24-hour periods from delivery or posting (two more days when the notice is mailed).

Three-day notice for unpaid rentK.S.A. 58-2564(b)

ACCEPTING LATE RENT (K.S.A. 58-2566): Landlord's acceptance of late rent without reservation, or of performance other than rent that varies from this Lease, waives Landlord's right to terminate this Lease for that breach, unless the parties agree otherwise after the breach occurs. Any other failure to insist on strict performance is not a waiver of a later breach.

Accepting late rentK.S.A. 58-2566

ATTORNEYS' FEES (K.S.A. 58-2547(a)(3)): A lease term by which Tenant or Landlord agrees to pay either party's attorneys' fees is unenforceable in Kansas, so this Lease contains none. A court may award fees only where a statute provides for them.

No attorney fee clauseK.S.A. 58-2547(a)(3)

Application and screening fees

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, limits application or screening fees.

K.S.A. 58-2540 to 58-2573

  • You may not deny tenancy to an applicant who otherwise qualifies because the applicant is, was within the past 12 months, or is in imminent danger of becoming a victim of domestic violence, sexual assault, human trafficking or stalking. K.S.A. 58-25,137(a)(1) K.S.A. 58-25,137(f) See Victims of domestic violence, sexual assault, trafficking or stalking on the Kansas page
  • Kansas fair housing law bars refusing to rent because of race, religion, color, sex, disability, familial status, national origin or ancestry. K.S.A. 44-1016(a) See Fair housing on the Kansas page
  • From July 1, 2026, a city or county may not limit your use of income tests, credit, eviction, property damage or criminal history under your usual screening criteria. SB 391 (2026)
  • When reviewing an eviction record, check the current court disposition rather than treating an old filing as a permanent judgment. Since July 1, 2026, eligible residential eviction records can be expunged through a court request. The process is not automatic: it generally requires three years since judgment, satisfaction of the related monetary judgment and no additional covered eviction judgment during that period. See the eviction process section for the notice and objection procedure. 2026 Kansas Laws, ch. 132, sec. 1 Kansas Judicial Council, July 1, 2026 notice See Eviction process on the Kansas page
  • An unsatisfied monetary judgment prevents expungement unless the plaintiff and defendant agree. Expungement does not erase the underlying debt or separate civil remedies, and public housing authorities retain the access specified for federal housing applications. Check the order and applicable reporting requirements before relying on a screening report. 2026 Kansas Laws, ch. 132, sec. 1(a)(5) to (7)

Fair housing

Partly read

Kansas law makes it unlawful to refuse to rent, set different terms, or advertise a preference because of race, religion, color, sex, disability, familial status, national origin or ancestry.

K.S.A. 44-1016(a) K.S.A. 44-1016(b) K.S.A. 44-1016(c)

  • Refusing reasonable modifications at the tenant's expense, or reasonable accommodations in rules and policies, needed by a person with a disability is discrimination. K.S.A. 44-1016(h)(3)
  • Familial status means having a child under 18 living with a parent, custodian or their designee. K.S.A. 44-1015(i)
  • You may not deny, evict or find in breach a tenant because the tenant is a victim of domestic violence, sexual assault, human trafficking or stalking. K.S.A. 58-25,137(a) See Victims of domestic violence, sexual assault, trafficking or stalking on the Kansas page

Required disclosures

At or before the start of the tenancy you must disclose in writing the name and address of the person managing the premises and of an owner or agent for service of process and notices. You and the tenant must also complete a joint move-in inventory within five days.

K.S.A. 58-2551(a) K.S.A. 58-2548

  • Keep the owner and manager disclosure current. K.S.A. 58-2551(b) See Owner and manager disclosure on the Kansas page
  • A form you give the tenant to sign as notice to vacate that adds terms not in the lease must carry the statutory warning in bold type. K.S.A. 58-2570(e) See Ending a month-to-month tenancy on the Kansas page
  • Some lease terms are unenforceable in Kansas, and knowingly using them can cost you the tenant's actual damages. K.S.A. 58-2547 See Lease terms Kansas forbids on the Kansas page
  • Federal law also requires that, for target housing, before the tenant is bound by the lease you give the EPA lead hazard pamphlet and disclose any known lead-based paint or lead hazards and any available report. 42 U.S.C. 4852d
In the Rentari Kansas lease

The Rentari Kansas lease includes the owner and manager disclosure, attaches the move-in inventory, and attaches the federal lead-based paint disclosure when you mark the home as built before 1978.

Flood disclosure

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, requires a flood disclosure.

K.S.A. 58-2540 to 58-2573

Owner and manager disclosure

At or before the start of the tenancy you, or whoever signs leases for you, must disclose in writing the name and address of the person authorized to manage the premises and of an owner or a person authorized to accept service of process, notices and demands for the owner.

K.S.A. 58-2551(a)

  • The information must be kept current and binds any later landlord, owner or manager. K.S.A. 58-2551(b)
  • A person who does not make the disclosure becomes the landlord's agent for service and notices and for the landlord's duties, and a manager who does not disclose counts as the landlord. K.S.A. 58-2551(c) K.S.A. 58-2543(e)
  • A landlord who sells in good faith is freed from later obligations once the tenant has written notice of the sale, but stays liable for the deposit. K.S.A. 58-2554(a)

Deposits, rent and fees

Security deposit limit

For an unfurnished unit you may not demand or receive a security deposit of more than one month's periodic rent. Where the lease lets the tenant use your furniture the limit is 1 1/2 months' rent, and where the lease permits pets you may take an additional deposit of up to 1/2 of one month's rent.

K.S.A. 58-2550(a)

  • A security deposit is any sum the lease sets for the tenant to deposit as a condition of moving in that the tenant may forfeit for breaking lease conditions, whatever it is called. K.S.A. 58-2543(m)
  • A municipal housing authority that receives federal aid and sets rent solely by the tenant's income may use a deposit schedule based on bedroom size, and must then offer a deferred payment plan. K.S.A. 58-2550(a)
  • Unless the lease says otherwise, the tenant may not use the deposit as the last month's rent. A tenant who does forfeits the deposit, and you may recover the rent as if it had not been applied. K.S.A. 58-2550(d)

Returning the deposit

When the tenancy ends you may apply the deposit to accrued rent and to damages from the tenant's breach of the lease or of the tenant duties in K.S.A. 58-2555, itemized in a written notice to the tenant. If you keep any part for charges other than rent, you must return the balance within 14 days after those charges are determined, and never later than 30 days after the tenancy ends, possession is delivered and the tenant demands it.

K.S.A. 58-2550(b)

  • If the tenant makes no demand within 30 days after the tenancy ends, you must mail the amount due to the tenant's last known address. K.S.A. 58-2550(b)
  • A landlord who does not follow these rules owes the portion due plus damages of 1 1/2 times the amount wrongfully withheld. K.S.A. 58-2550(c)
  • Whoever holds the landlord's interest when the tenancy ends is bound by the deposit rules, and a landlord who sells in good faith stays liable for the deposit the tenant is owed. K.S.A. 58-2550(f) K.S.A. 58-2554(a)
  • When the tenant ends the lease for your uncured noncompliance, a fire or casualty, or an unlawful lockout or utility cut-off, you must return the part of the deposit the tenant can recover. K.S.A. 58-2559(c) K.S.A. 58-2562(b) K.S.A. 58-2563
In the Rentari Kansas lease

The Rentari Kansas lease states the 14-day and 30-day deadlines, the mailing rule when no demand is made and the 1 1/2 times damages.

Deposit account and interest

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, requires you to hold deposits in a separate account or to pay interest on them.

K.S.A. 58-2540 to 58-2573

  • The holder of the landlord's interest when the tenancy ends is bound by the deposit return rules. K.S.A. 58-2550(f) See Returning the deposit on the Kansas page

Move-in inventory

Within five days of the first day of occupancy, or when you deliver possession, you or your representative and the tenant must jointly inventory the premises and complete a written record of the condition of the premises and of any furnishings or appliances you provide.

K.S.A. 58-2548

  • Both of you sign duplicate copies of the record to show the inventory was completed, and the tenant must be given a copy. K.S.A. 58-2548
  • At the start of the term you must deliver possession in compliance with the lease and your maintenance duties. K.S.A. 58-2552
In the Rentari Kansas lease

Every Rentari Kansas lease attaches a move-in inventory addendum that states the five-day joint inventory, whether or not a deposit is taken.

Rent and late fees

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, limits late fees or sets a grace period. Rent is due without demand or notice at the time and place you and the tenant agree.

K.S.A. 58-2540 to 58-2573 K.S.A. 58-2545(c)

  • Unless you agree otherwise, rent is payable at the unit, at the start of each rental period of one month or less, and otherwise in equal monthly installments at the start of each month. K.S.A. 58-2545(c)
  • Rent means every payment due to the landlord under the lease other than the security deposit. K.S.A. 58-2543(j)
  • A court may refuse to enforce, or may limit, a lease term it finds was unconscionable when made. K.S.A. 58-2544(a)
  • Accepting late rent without reservation waives your right to terminate for that breach, unless you agree otherwise after it happens. K.S.A. 58-2566 See Notice for unpaid rent on the Kansas page
In the Rentari Kansas lease

The Rentari Kansas lease charges the late fee you set after the grace day you choose and says no Kansas statute sets a late-fee amount.

Returned check fee

The service charge on a check dishonored because the writer had no account or not enough funds may not exceed $30.

K.S.A. 60-2610(g)

  • To recover more in court, the holder must make a written demand for the check amount, the service charge and interest at least 14 days before filing. A writer who does not pay may then owe court costs, interest, collection costs and attorney fees, plus the greater of $100 or three times the check amount, capped at $500 over the check amount. K.S.A. 60-2610(a) K.S.A. 60-2610(b)
In the Rentari Kansas lease

The Rentari Kansas lease limits the returned-payment fee to $30 even if you enter more.

Rent increases

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, sets a notice period or a limit for rent increases, so the lease sets the rent for its term.

K.S.A. 58-2540 to 58-2573

  • You may not raise rent to retaliate for a code complaint, a repair complaint or joining a tenants' union, except a good-faith increase to cover higher costs that does not conflict with the lease. K.S.A. 58-2572(a) K.S.A. 58-2572(c) See Retaliation on the Kansas page
  • Either party may end a month-to-month tenancy with written notice that it ends on a rent-paying date at least 30 days after receipt. K.S.A. 58-2570(b) See Ending a month-to-month tenancy on the Kansas page
  • Cities and counties may not control the amount of rent on private property. K.S.A. 12-16,120(a) See Rent control and local rules on the Kansas page
In the Rentari Kansas lease

The Rentari Kansas lease states the retaliation limit on raising rent.

During the tenancy

Landlord entry

You may enter at reasonable hours, after reasonable notice, to inspect, make necessary or agreed repairs or improvements, supply necessary or agreed services, or show the unit to buyers, lenders, tenants, workers or contractors. The Act sets no number of hours.

K.S.A. 58-2557(a)

  • You may enter without the tenant's consent in an extreme hazard involving the potential loss of life or severe property damage. K.S.A. 58-2557(b)
  • You may not abuse the right of access or use it to harass the tenant. K.S.A. 58-2557(c)
  • During a tenant's absence of more than 30 days you may enter at times reasonably necessary. K.S.A. 58-2565(b)
  • If the tenant refuses lawful access you may seek a court order or terminate the lease, and recover actual damages. If you enter unlawfully, unreasonably or harass with repeated demands, the tenant may seek a court order or terminate, and recover actual damages. K.S.A. 58-2571(a) K.S.A. 58-2571(b)
In the Rentari Kansas lease

The Rentari Kansas lease gives at least 24 hours' notice, or the period you choose, as a term of the lease rather than as Kansas law.

Repairs and habitability

Unless prevented by an act of God, a utility failure or other conditions beyond your control, you must follow building and housing codes materially affecting health and safety, use reasonable care in maintaining common areas, keep the electrical, plumbing, sanitary, heating, ventilating and air-conditioning appliances, including elevators, that you supply or are required to supply in good and safe working order, provide trash receptacles and removal unless a government does, and supply running water, reasonable hot water and reasonable heat.

K.S.A. 58-2553(a)

  • The heat and hot water duty does not apply where the building is not required by law to have them, or where the tenant controls an installation supplied by a direct utility connection. K.S.A. 58-2553(a)(5)
  • You may not block a tenant's access to a communication or cable television service franchised by a municipality. K.S.A. 58-2553(a)
  • In a building of up to four households you and the tenant may agree in writing, in good faith, that the tenant handles the trash, running water, hot water and heat duties and specified repairs. K.S.A. 58-2553(b)
  • In any unit other than a single family residence, the tenant may take on specified repairs only by a separate signed written agreement with adequate consideration, not to cure code violations, and you may not make it a condition of the lease. K.S.A. 58-2553(c) K.S.A. 58-2553(d)
  • The tenant must keep the unit clean and safe, use appliances reasonably, not disturb other tenants, and is responsible for damage caused by the tenant, guests or pets. K.S.A. 58-2555
In the Rentari Kansas lease

The Rentari Kansas lease restates your statutory maintenance duties.

Tenant repair remedies

For your material noncompliance with the lease, or a failure in your maintenance duties materially affecting health and safety, the tenant may give written notice naming the breach and ending the lease on a rent-paying date at least 30 days after you receive it. If the breach can be remedied and you begin a good-faith effort within 14 days after receiving the notice, the lease does not end.

K.S.A. 58-2559(a)

  • If the same or a similar breach happens after the 14 days, the tenant may give a new 30-day notice that ends the lease. K.S.A. 58-2559(a)(1)
  • The tenant may not terminate for a condition the tenant, a guest or a pet caused. K.S.A. 58-2559(a)(2)
  • The tenant may also recover damages and obtain a court order for your noncompliance. K.S.A. 58-2559(b)
  • No section of the Act lets the tenant repair and deduct the cost from rent. K.S.A. 58-2540 to 58-2573
  • In your suit for possession based on unpaid rent, the tenant must counterclaim or lose the claim, and the court may order rent paid into court. K.S.A. 58-2561(a) See Eviction process on the Kansas page
  • If fire or casualty substantially impairs the unit, the tenant may vacate and give written notice within five days to end the lease, or vacate the unusable part and pay reduced rent. K.S.A. 58-2562(a)
  • If you fail to deliver possession, rent abates and the tenant may end the lease on at least five days' written notice, or sue for possession and damages. On termination you must return the whole deposit. A willful failure to deliver possession that is not in good faith can cost up to 1 1/2 months' rent or 1 1/2 times actual damages, whichever is greater. K.S.A. 58-2560
In the Rentari Kansas lease

The Rentari Kansas lease states the 14-day and 30-day tenant remedy and says the Act gives no right to repair and deduct.

Locks and security devices

Not set by statute

No section of the Kansas Residential Landlord and Tenant Act, read whole, requires particular locks or rekeying between tenants.

K.S.A. 58-2540 to 58-2573

  • You must follow building and housing codes materially affecting health and safety, which include any law or local ordinance on fitness for habitation. K.S.A. 58-2553(a)(1) K.S.A. 58-2543(b)
In the Rentari Kansas lease

The Rentari Kansas lease has you provide working exterior locks and bars the tenant from changing or rekeying them without your written permission.

Smoke and carbon monoxide alarms

Partly read

The Kansas Residential Landlord and Tenant Act does not mention smoke or carbon monoxide alarms. Kansas fire safety rules and city codes were not read for this page, so check them.

K.S.A. 58-2540 to 58-2573

In the Rentari Kansas lease

The Rentari Kansas lease has you provide working smoke and carbon monoxide detectors at move-in and bars the tenant from disabling them.

Retaliation

You may not retaliate by raising rent or cutting services because the tenant complained to a code enforcement agency about a violation materially affecting health and safety, complained to you about your maintenance duties, or organized or joined a tenants' union or similar group.

K.S.A. 58-2572(a)

  • A tenant retaliated against may recover possession or terminate and recover up to 1 1/2 months' rent or actual damages, whichever is greater, and has a defense to your suit for possession. K.S.A. 58-2572(b) K.S.A. 58-2563
  • You may still raise rent in good faith to cover acts of God, utility rate increases, property tax increases or other higher operating costs, if the increase does not conflict with the lease. K.S.A. 58-2572(c)
  • You may still sue for possession if the tenant caused the code violation, is behind on rent, or the repairs required would deprive the tenant of the unit. K.S.A. 58-2572(d)
In the Rentari Kansas lease

The Rentari Kansas lease states the retaliation rule, its remedies and its exceptions.

Lockouts and utility shutoffs

You may not recover or take possession of the unit by any means, including interrupting electric, gas, water or other essential service, except after abandonment, surrender or as the Act permits.

K.S.A. 58-2569

  • If you unlawfully remove or exclude the tenant or willfully cut essential services, the tenant may recover possession or terminate, and recover up to 1 1/2 months' rent or actual damages, whichever is greater. K.S.A. 58-2563
  • Apart from the abandoned property procedure, distraint for rent is abolished, and a landlord's lien on the tenant's household goods is unenforceable unless it was perfected before the Act took effect. K.S.A. 58-2567
  • The tenant still pays for utilities as the lease provides. K.S.A. 58-2553(a)
  • From July 1, 2026, someone occupying without a lease or a tenant's permission (not a tenant or a periodic holdover) is outside the Act. You can have that person removed by giving local law enforcement a sworn affidavit under the Removal of Squatters Act. Never use it against a tenant: a wrongful removal can bring restored possession, actual damages, punitive damages of three times the fair market rent, costs and attorney fees. HB 2378 (2026)
In the Rentari Kansas lease

The Rentari Kansas lease states that you may not take possession or interrupt essential services outside the Act.

Ending a month-to-month tenancy

You or the tenant may end a month-to-month tenancy with written notice that it ends on a periodic rent-paying date at least 30 days after the other party receives the notice. A week-to-week tenancy ends on written notice given at least seven days before the date in the notice.

K.S.A. 58-2570(a) K.S.A. 58-2570(b)

  • A tenant in the United States military service whose orders require the move needs to give no more than 15 days' written notice. K.S.A. 58-2570(b)
  • A lease for a definite term of more than 30 days is not a month-to-month tenancy even if rent is paid every 30 days. Without a definite term, the tenancy is month-to-month, or week-to-week for a roomer who pays weekly. K.S.A. 58-2570(b) K.S.A. 58-2545(d)
  • If a tenant stays after the tenancy ends without your consent you may sue for possession, and a willful holdover not in good faith can owe up to 1 1/2 months' rent or 1 1/2 times your actual damages, whichever is greater. K.S.A. 58-2570(c)
  • If you hand the tenant a form that would serve as the tenant's notice to vacate and it adds terms not in the lease, it must carry the statutory warning in at least ten-point bold type, or the added terms do not bind the tenant. K.S.A. 58-2570(e)
In the Rentari Kansas lease

The Rentari Kansas lease states the 30-day rent-paying-date rule and the 15-day military notice.

Ending a fixed-term lease early

No section of the Act gives either side a general right to end a fixed-term lease early. A tenant may end it in specific cases: your uncured material noncompliance, fire or casualty, an unlawful lockout or utility cut-off, unlawful entry, or your failure to deliver possession.

K.S.A. 58-2559(a) K.S.A. 58-2562(a) K.S.A. 58-2563 K.S.A. 58-2571(b) K.S.A. 58-2560

  • A tenant who is a victim of domestic violence, sexual assault, human trafficking or stalking and gives you a statement owes no rent for the time after vacating. K.S.A. 58-25,137(b) K.S.A. 58-25,137(c) See Victims of domestic violence, sexual assault, trafficking or stalking on the Kansas page
  • Under federal law a servicemember may end a residential lease after entering military service, or after orders for a permanent change of station or a deployment of at least 90 days, by written notice with a copy of the orders. With monthly rent, the end is 30 days after the next rent due date following the notice. A spouse or dependent may also end the lease within one year after the servicemember dies in service, and the lease may be ended within one year after a catastrophic injury or illness in service. A servicemember who signed on receipt of orders may end it after a stop movement order of 30 days or more that prevents occupancy, effective when the notice and orders are delivered. 50 U.S.C. 3955
  • If a tenant abandons the unit you must make reasonable efforts to rent it at a fair rental. The old lease ends when a new tenancy begins, or when you learn of the abandonment if you do not try to re-rent or accept it as a surrender. K.S.A. 58-2565(c) See Abandonment and property left behind on the Kansas page
In the Rentari Kansas lease

The Rentari Kansas lease states the domestic violence, military, fire and casualty and landlord noncompliance rules, and sets no termination fee for a protected tenant.

Notice for unpaid rent

If rent is unpaid when due, you may terminate the lease if the tenant does not pay within three days after your written notice of the nonpayment and of your intention to terminate if the rent is not paid within that time. The three days are three consecutive 24-hour periods.

K.S.A. 58-2564(b)

  • The three days start when the notice is delivered to the tenant or to someone over 12 living there, or posted in a conspicuous place. If you mail it, allow two more days from the mailing date. K.S.A. 58-2564(b)
  • Before filing an eviction suit you must deliver a notice to leave at least three days (three consecutive 24-hour periods) before filing, plus two more days from the mailing date if you mail it. Weekends and holidays count, and this notice may be combined with the Act's notice. K.S.A. 61-3803 See Eviction process on the Kansas page
  • Accepting late rent without reservation waives your right to terminate for that late payment, unless you agree otherwise after it. K.S.A. 58-2566
In the Rentari Kansas lease

The Rentari Kansas lease and its three-day notice state your intention to terminate and how the three days are counted.

Notice for other lease violations

For a material noncompliance with the lease, or with the tenant's duties materially affecting health and safety, you may give written notice naming the breach and stating that the lease ends on a date at least 30 days after the tenant receives it if the breach is not remedied in 14 days. If the breach can be remedied and the tenant starts a good-faith effort before the date in the notice, the lease does not end.

K.S.A. 58-2564(a)

  • If the same or a similar breach happens after the 14 days, you may give a notice ending the lease at least 30 days after receipt with no chance to remedy. K.S.A. 58-2564(a)
  • You may also recover damages and obtain a court order for the tenant's noncompliance. K.S.A. 58-2564(c)
  • If the tenant refuses lawful access, you may terminate the lease or seek a court order, and recover actual damages. K.S.A. 58-2571(a)
  • A house rule binds the tenant only if it meets the Act's tests and the tenant had notice of it when signing the lease; a later rule that substantially changes the lease needs the tenant's written consent. K.S.A. 58-2556
  • Accepting performance that varies from the lease waives your right to terminate for that breach, unless you agree otherwise after it. K.S.A. 58-2566
In the Rentari Kansas lease

The Rentari Kansas lease states the 14-day chance to remedy and the 30-day termination date.

Eviction process

Evictions are lawsuits under K.S.A. 61-3801 to 61-3808, filed after a notice to leave delivered at least three days before filing, plus two days if it is mailed. The summons sets an appearance date 3 to 14 days after it is issued, and any trial must be held within 14 days after that date. From July 1, 2026, the court must consider mediation unless it finds mediation would not materially help the parties or is impracticable, and it must continue the case up to 14 days from a mediation order while the parties mediate.

K.S.A. 61-3801 to 61-3808 K.S.A. 61-3803 K.S.A. 61-3805 K.S.A. 61-3807(a) Sub. for HB 2357 (2026)

  • The petition describes the premises and why you seek possession, and may ask for unpaid rent. K.S.A. 61-3804
  • Outside mediation, a tenant who asks for a continuance must post a bond for the rent and damages that may accrue. From July 1, 2026, the court must continue the case up to 14 days from its mediation order while the parties mediate, with no bond required. K.S.A. 61-3807(b) Sub. for HB 2357 (2026)
  • From July 1, 2026, the court must consider mediation in an eviction case unless it finds mediation would not materially help the parties or is impracticable. K.S.A. 61-3806(c) Sub. for HB 2357 (2026)
  • After judgment, the court issues a writ of restitution on your request, and it must be executed within 14 days after the officer receives it. K.S.A. 61-3808
  • You may ask for immediate possession by motion; after a hearing, the judge may order it if you give an undertaking the court sets. K.S.A. 58-2570(d)
  • Claims under the Act are heard in district court and may be brought under the code of civil procedure for limited actions. K.S.A. 58-2542
  • Retaliation is a defense to a suit for possession. K.S.A. 58-2572(b) See Retaliation on the Kansas page
  • From July 1, 2026, a former tenant may ask the court to expunge an eviction case under the Act. You have 30 days after being served to object. Without an objection the court decides without a hearing and presumes any money judgment is paid. The court must grant expungement once three years have passed since judgment, any money judgment is satisfied and there is no newer eviction judgment. Expungement does not cancel what the tenant owes you. Sub. for HB 2357 (2026)
In the Rentari Kansas lease

The Rentari Kansas lease says a claim under the Act may be brought in district court under the code for limited actions.

Abandonment and property left behind

You may treat the unit as abandoned if the tenant is 10 days behind on rent and has removed a substantial part of the belongings, unless the tenant told you otherwise. Property left after abandonment, surrender or a court eviction may be stored at the tenant's expense and sold or disposed of 30 days after you take possession of it.

K.S.A. 58-2565(b) K.S.A. 58-2565(d)

  • At least 15 days before the sale you must publish notice once in a newspaper of general circulation in the county, and mail a copy to the tenant's last known address within seven days after publication, naming the tenant, describing the property and giving the approximate sale date. K.S.A. 58-2565(d)
  • Until the sale the tenant may redeem the property by paying your reasonable costs of taking, holding and preparing it and any amount owed to you. K.S.A. 58-2565(d)
  • Sale proceeds go first to your costs, then to what the tenant owes; you may keep any balance, subject to a secured creditor who gave you notice. K.S.A. 58-2565(e)
  • You must make reasonable efforts to re-rent an abandoned unit at a fair rental. K.S.A. 58-2565(c) See Ending a fixed-term lease early on the Kansas page

Small claims

Partly read

Small claims court handles claims for money or personal property of up to $10,000, not counting interest, costs and worthless-check damages.

K.S.A. 61-2703(a)

  • A small claim may not be an assigned claim, a claim obtained through subrogation, or a debt owed to someone else unless you are that person's full-time employee or officer. K.S.A. 61-2703(a)
  • Claims under the Act belong in district court and may be brought under the code of civil procedure for limited actions. K.S.A. 58-2542

Lease terms Kansas forbids

A Kansas lease may not make either party waive rights under the Act, authorize a confession of judgment, agree to pay either party's attorney fees, or excuse, limit or indemnify either party's liability arising under law. Such a term is unenforceable.

K.S.A. 58-2547(a) K.S.A. 58-2547(b)

  • A lease may still have the tenant limit your liability for fire, theft or breakage in common areas. K.S.A. 58-2547(a)(4)
  • If you knowingly use a lease with a forbidden term, the tenant may recover actual damages. K.S.A. 58-2547(b)
  • A signed lease you never signed back takes effect if you knowingly accept rent without reservation, but a lease given effect this way lasts no more than one year. K.S.A. 58-2546

Victims of domestic violence, sexual assault, trafficking or stalking

A tenant who is a protected person and gives you a statement about the domestic violence, sexual assault, human trafficking or stalking owes no rent for the period after vacating. A protected person is someone who, in the past 12 months, has been, is, or is in imminent danger of becoming a victim.

K.S.A. 58-25,137(b) K.S.A. 58-25,137(c) K.S.A. 58-25,137(f)

  • If you ask, the tenant must give documentation: a document signed by the victim and a licensed physician, physician assistant, nurse or behavioral sciences professional declaring under penalty of perjury that the professional believes the incident occurred, or a court order granting relief. K.S.A. 58-25,137(c)
  • Rent and other amounts owed for the time before vacating remain due. K.S.A. 58-25,137(b)(3)
  • You may charge a reasonable termination fee of up to one month's rent only if the lease states it. K.S.A. 58-25,137(e)
  • The lease continues for any remaining tenants, and these rights cannot be waived. K.S.A. 58-25,137(h) K.S.A. 58-25,137(g)
  • A court may award $1,000 in statutory damages plus attorney fees and costs against a landlord who violates the section. K.S.A. 58-25,137(i)

Local rules

Rent control and local rules

No Kansas city, county or township may enact or enforce a rule that controls the amount of rent on privately owned residential property. From July 1, 2026, cities and counties also may not require voucher acceptance, limit tenant screening, cap security deposits or require a tenant right of first refusal.

K.S.A. 12-16,120(a) SB 391 (2026)

  • A local government may still manage property it owns, and an owner may voluntarily agree to rent limits in return for local grants or incentives. K.S.A. 12-16,120(b) K.S.A. 12-16,120(c)
  • A local government may not require rent limits as a condition of a building permit, plat or zoning decision. K.S.A. 12-16,120(d)
  • From July 1, 2026, no Kansas city or county may adopt or enforce a rule that stops you from refusing housing choice voucher or other voluntary housing assistance income, limits your use of income tests, credit, eviction, property damage or criminal history under your usual criteria, caps the security deposit, or requires a tenant right of first refusal. Such rules adopted earlier are void. SB 391 (2026)
Kansas cities and counties

Cities and counties have their own housing, building and fire codes that can add duties for rental property. None was read for this page, so no local rule is listed here; check the codes where your property is. State law bars local rent control and, from July 1, 2026, local voucher-acceptance mandates, screening limits, deposit caps and tenant right of first refusal rules.

Kansas lease renewals

Read the agreement's renewal clause and the notice rules above before choosing a new term, changing rent or ending the tenancy. A fixed end date does not override applicable renewal rights, rent regulation, just-cause rules or protections against retaliation and discrimination.

Confirm the notice, timing and delivery requirements for the rental's state and locality. Review any required new disclosures and attachments when preparing the renewal. Get the parties' agreement to changed terms in writing.

Customize an unsigned agreement or prepare an addendum to an existing lease.

Kansas lease questions

Does the Rentari Kansas lease include an attorney fee clause?

No. Kansas makes a lease term requiring either party to pay attorney fees unenforceable, so the Kansas lease says it contains none. It also leaves out the tenant indemnity clause for the same reason.

K.S.A. 58-2547(a)

How does the Kansas lease handle the security deposit?

It states the amount, the one month, 1 1/2 month and pet limits, and the return rule: 14 days after charges are determined, never later than 30 days after the tenancy ends, possession is delivered and the tenant demands it. For now Rentari accepts a Kansas deposit of no more than one month's rent.

K.S.A. 58-2550(a) K.S.A. 58-2550(b)

Does the Kansas lease include the move-in inventory?

Yes. Every Kansas lease attaches a move-in inventory addendum stating that you and the tenant jointly inventory the unit within five days and both sign it.

K.S.A. 58-2548

What late fee and returned check fee does the Kansas lease set?

The late fee is the amount you choose, charged after the grace day you choose, and the lease says no Kansas statute sets a late-fee amount. The returned check fee is limited to $30.

K.S.A. 58-2540 to 58-2573 K.S.A. 60-2610(g)

Does the Kansas lease cover domestic violence protections?

Yes. It states that a protected tenant who gives you a statement owes no rent after vacating, what documentation you may request, and that the lease sets no termination fee.
